This Agreement takes effect on the date on which you first create an account or use the Nestscan Service. By accessing or using the Service, you agree to be bound by these Terms.

3. Service Description

Nestscan uses artificial intelligence to discover and extract property listings from various third-party websites including real estate agencies, property aggregators, and listing platforms. The Service provides users with a consolidated view of available properties matching their search criteria.

Important: Nestscan does not own, manage, or verify any of the properties displayed. We are a discovery and aggregation service only. All property information originates from third-party sources.

4. AI-Extracted Information Disclaimer

Property information displayed on Nestscan is extracted using artificial intelligence from third-party websites. Due to the automated nature of this process:

• Information may be incomplete, inaccurate, or outdated
• Prices, availability, and property details may have changed since extraction
• AI extraction may misinterpret or incorrectly parse source data
• Images, descriptions, and specifications may not accurately represent properties
• Contact information may be incorrect or no longer valid

You must always verify all property information directly with the original source website or property owner/agent before making any decisions. Links to original listings are provided for this purpose.

5. No Responsibility for Third-Party Content

Nestscan acts solely as an aggregator of publicly available information. We do not:

• Verify the accuracy, legality, or legitimacy of any property listing
• Guarantee the availability of any property
• Endorse or recommend any property, landlord, agent, or agency
• Have any relationship with property owners, agents, or listing websites
• Participate in or facilitate property transactions

We are not responsible for any content, offers, or representations made on third-party websites, even if discovered through our Service.

6. User Accounts and Authentication

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

8. Pricing and Subscriptions

Nestscan offers both free and premium subscription tiers. Free accounts include basic features with usage limitations. Premium subscriptions provide access to more search regions, unlimited scans, and additional features.

Subscription fees are billed on a recurring basis (monthly or annually) and will automatically renew unless cancelled before the renewal date. We reserve the right to modify pricing with reasonable notice to existing subscribers.

9. Refunds and Cancellations

You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period. Refunds may be considered on a case-by-case basis within 14 days of initial purchase. Contact support to request a refund review.

10. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or other users' accounts

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE SPECIFICALLY DISCLAIM ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF PROPERTY INFORMATION DISPLAYED THROUGH THE SERVICE. AI-EXTRACTED DATA MAY CONTAIN ERRORS, OMISSIONS, OR OUTDATED INFORMATION.

We do not warrant that properties displayed are available, accurately priced, legally rentable, or suitable for any particular purpose.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Nestscan SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Decisions made based on property information displayed through the Service
• Financial losses from relying on inaccurate or outdated listing information
• Failed property viewings, rentals, or purchases due to incorrect information
• Dealings with third-party property owners, agents, or agencies
• Any disputes arising from properties discovered through the Service
• Scams, fraud, or misrepresentation by third parties
• Loss of time, opportunity, or other intangible losses

YOU ACKNOWLEDGE THAT YOU USE PROPERTY INFORMATION AT YOUR OWN RISK AND THAT YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL INFORMATION BEFORE TAKING ANY ACTION.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless Nestscan, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service, your dealings with third-party property providers, violation of these Terms, or infringement of any rights of another party.
